Possible penalties

Indictable criminal complaints, which are heard in the Superior Court of New Jersey, are the most serious offenses. These crimes—such as aggravated assault, drug possession and distribution, criminal sexual contact, theft by deception and terroristic threats—are indictable, and if you are found guilty, you could lose your personal freedom through a sentence in the county jail or state prison.

Criminal complaints that are heard in Municipal Courts—such as possession of drugs, underage drinking, simple assault, shoplifting or criminal mischief—are considered disorderly persons offenses. Still, if you are found guilty, you could lose your driver’s license, be sentenced to county jail and be forced to pay substantial fines. Again, you could lose your driver’s privileges—even if the offense had nothing to do with operating a motor vehicle.

Traffic violations that are heard in Municipal Courts—such as driving while intoxicated (DWI), speeding, driving while suspended, leaving the scene of an accident, driving without insurance, moving violations and more, can also impact your life severely.
